Terms of Service

1. Acceptance of Terms

• By accessing HitchRally, you agree to be bound by these Terms. We write our Terms in plain English, but they remain a legally binding agreement.

2. Description of Service

• HitchRally is an AI-powered party planning platform designed for bachelorette and bachelor parties.
• Users can create a party, take a "Vibe Quiz", and receive personalized AI-generated itineraries. The Platform also provides group coordination tools such as polls, expense tracking, messaging, and RSVP management.

3. Account Registration & Security

• Users may register using Google OAuth, via a magic link through Supabase Auth, or by being invited as a guest via phone number or email.
• You are responsible for maintaining the confidentiality of your login credentials and are liable for all activities under your account.
• You agree to provide accurate information upon registration. HitchRally reserves the right to suspend or terminate accounts that violate these security rules.

4. SMS/Text Messaging Terms

• Consent: By providing your phone number to us or to your party host, you consent to receive text/SMS messages from HitchRally LLC via our provider (Twilio). This consent is NOT a condition of making any purchase.
• Message Types & Frequency: You will receive messages related to platform usage, including party invitations, itinerary updates, poll notifications, expense reminders, and group coordination alerts. Message frequency will vary depending on your party's activity level.
• Opt-Out: Stop receiving messages at any time by replying STOP. After texting STOP, you may receive a single confirmation message, after which no further messages will be sent to that number unless you manually opt back in.
• Help: Reply HELP for assistance, or contact us at support@hitchrally.com.
• Rates & Liability: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• Privacy: Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

6. User Conduct

• You agree to use HitchRally for its intended party-planning purposes.
• You will not use the platform for any illegal activities, harassment, hate speech, or the distribution of illicit material.
• We reserve the right to remove non-compliant content and terminate accounts at our sole discretion.

7. Intellectual Property

• Platform & AI Content: HitchRally owns the platform's codebase, matching designs, logos, and the copyright to all AI-generated itinerary formats.
• User Content: You retain full ownership of your personal content (e.g., photos, messages, custom notes). By uploading content, you grant HitchRally a non-exclusive license to display it within the platform to you and your invited party members.

8. Premium Features and Payments

• HitchRally offers both a per-party pass and a monthly subscription tier. Billing is securely handled by Stripe.
• Subscriptions: Monthly subscriptions will auto-renew until canceled from your account settings.
• Refund Policy: Payments are generally non-refundable once an AI itinerary has been generated or premium services have been utilized, except where mandated by law.

9. Group Cost-Splitting Disclaimer

• HitchRally provides expense tracking and calculation tools only.
• We do not hold, transmit, or process funds between users. Actual money transfers occur off-platform via third-party apps selected by users (e.g., Venmo, CashApp).
• HitchRally is not liable for unpaid debts, financial disputes, or issues relating to third-party payment gateways.

10. Privacy

• How we handle your data is outlined in our Privacy Policy. By using the Platform, you acknowledge that you have read and consent to the data practices described at hitchrally.com/privacy.

11. Limitation of Liability

• To the fullest extent permitted by law, HitchRally's total liability to you for all claims arising out of or relating to these Terms is limited to the amount you have paid to us in the past 12 months, or $100 if you use the free version.
• We hold no liability for AI-generated recommendations, the actions of third-party vendors, travel disruptions, group coordination outcomes, or disputes amongst party members.

12. Indemnification

• You agree to indemnify, defend, and hold harmless HitchRally LLC from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your interactions with other users.

13. Dispute Resolution

• Any dispute arising from these Terms will be resolved through binding individual arbitration instead of in court.
• Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Termination

• Either party may terminate this agreement at any time. You may cancel your account from within your settings.
• Upon termination, your right to use the Platform immediately ceases. Your data will be handled securely in accordance with our Privacy Policy.

15. Changes to Terms

• We may update these Terms periodically. Significant changes will be broadcast via email or via an in-app notification.
• Continuing to use HitchRally after these changes denotes your acceptance of the updated Terms.
